The PACT Act made many respiratory and cancer conditions presumptive for veterans with qualifying service. Conditions outside the presumptive list still require a nexus opinion — and so do presumptive conditions where the VA disputes the qualifying service or the diagnosis itself.
What the VA requires
- A current diagnosis
- Qualifying deployment or documented airborne hazard exposure
- For non-presumptive conditions, a medical opinion linking exposure to disease
How it is rated
Respiratory conditions are rated under 38 CFR 4.97, generally using pulmonary function testing values such as FEV-1 and DLCO.
